Terms and Conditions

You must be at least 18 years old and legally capable of entering into binding contracts. By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are using the Platform on behalf of an organization, you warrant that you have the authority to bind the entity to these Terms. Any registration, access, or use by individuals under 18 years of age is strictly prohibited.

• Provide accurate, current, and complete information when creating an account.
• Maintain and promptly update your information to keep it accurate and complete.
• Maintain the confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify Questify Holdings Inc. immediately of any unauthorized access or breach of security.

• Use the Platform only for lawful purposes and in accordance with these Terms.
• Circumventing security features is prohibited.
• Engaging in fraudulent, deceptive, or harmful activities is prohibited.
• Violating intellectual property or proprietary rights is prohibited.
• Using automated systems, bots, or scripts to scrape data is prohibited.
• Posting or transmitting harmful, unlawful, or inappropriate content is prohibited.
• Interfering with or disrupting the integrity or performance of the Platform is prohibited.

The Platform utilizes Meta APIs and other third-party services to facilitate lead generation. By using these services, you consent to the collection and processing of data as outlined in our Privacy Policy. You are responsible for ensuring compliance with all applicable data protection and privacy laws when accessing and utilizing lead information generated through the Platform.

Payments for services provided through the Platform must be made in accordance with the payment terms displayed at the time of purchase. Accepted payment methods include major credit cards, debit cards, and electronic transfers. Late payments may result in additional fees and suspension of access to the Platform. All fees are non-refundable unless otherwise specified. Questify Holdings Inc. reserves the right to modify fees and payment terms at its sole discretion.

All intellectual property rights, including but not limited to copyrights, trademarks, patents, and trade secrets, related to the Platform are owned by Questify Holdings Inc. or its licensors. Users are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform in accordance with these Terms. Unauthorized use of any intellectual property is strictly prohibited.

Users agree to maintain the confidentiality of all proprietary and confidential information obtained through the Platform. This includes, but is not limited to, lead data, software, business strategies, and technical specifications. Unauthorized disclosure of confidential information may lead to legal action by Questify Holdings Inc.

To the maximum extent permitted by law, Questify Holdings Inc. shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use of the Platform. This limitation applies to all claims, including but not limited to lost profits, lost data, and business interruptions. The liability of Questify Holdings Inc., if established, shall not exceed the amount paid by the User for the services provided.

Questify Holdings Inc. reserves the right to suspend or terminate your access to the Platform at any time, with or without cause. Grounds for termination may include but are not limited to violation of these Terms, fraudulent activity, or misuse of the Platform. Upon termination, you must cease all use of the Platform and destroy any content obtained through it. Termination does not affect any accrued rights or obligations.

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts in Calgary, Alberta. Users agree to waive any objection to the venue and jurisdiction of these courts.

In the event of a dispute, you agree to first attempt resolution through informal negotiation. If a resolution cannot be reached, you agree to engage in mediation or arbitration as a prerequisite to litigation. Legal actions must be brought within one (1) year from the date the cause of action arose.

Questify Holdings Inc. reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform, and continued use of the Platform constitutes acceptance of the revised Terms. It is the User's responsibility to review the Terms regularly.

Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, and protect your data. By agreeing to these Terms, you also consent to our Privacy Policy.

You agree to indemnify, defend, and hold harmless Questify Holdings Inc., its affiliates, officers, directors, employees, agents, and partners from any claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the Platform or breach of these Terms.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The failure of Questify Holdings Inc. to enforce any right or provision of these Terms will not constitute a waiver.

These Terms, along with the Privacy Policy, constitute the entire agreement between you and Questify Holdings Inc. regarding the use of the Platform, superseding any prior agreements or understandings.
